Contracts

Under the NHS Procurement, Patient Choice and Competition Regulations 2013, NHS Devon publishes all contracts entered into for the provision of health care services.

This includes details of the provider, a description of the service, contract value, the duration of the contract and the process adopted for selecting the provider.

The Health and Care Act 2022 introduced a new procurement regime, Provider Selection Regime (PSR), to follow when selecting providers of health care services in England. PSR came into force on 1 January 2024.

Integrated Care Boards (ICBs) and NHS Trusts are required to follow PSR when procuring health care services, in accordance with NHS England’s Provider Selection Regime statutory guidance.

Under PSR, commissioners and Trusts must identify which provider selection process is applicable for the health care service being procured and are required to establish and apply transparent, proportionate, and non-discriminatory criteria.

PSR route direct award process B facilitates the effective operation of choice by ensuring that prospective providers, including those that do not have a contract with an ICB or NHS Trust, have an opportunity to be included on the list of providers from which patients are offered a choice of provider.

When a provider approaches a commissioner seeking a contract to provide health care services to which patient choice applies, commissioners will need to assess whether the provider is eligible to offer the services.

NHS Devon Integrated Care Board, Torbay & South Devon NHS Foundation Trust, Devon Partnership NHS Trust and Livewell Southwest have developed a qualifying criteria process for providers to seek eligibility.
